AVOID HIGH STAKES RISKS IN COMPLIANCE PROGRAMS

Gaming Regulation Experts Present Three-Part Webinar Series on Anti-Money Laundering, Customer Privacy and Terrorism Regulations

EAST LANSING, MICH. (MARCH 23, 2010) - Regulators are increasingly turning a watchful eye on non-bank financial institutions such as casinos when it comes to compliance with anti-money laundering, customer privacy, and economic and trade sanction regulations. Even those casinos with solid gaming compliance programs intact need to comprehensively address these topics.

Regulatory Management Counselors, P.C., Resort Advantage, and Convey Compliance Systems, Inc., present a free three-part Webinar series to discuss key compliance issues for 2010 surrounding the Bank Secrecy Act (BSA), the Office of Foreign Asset Control (OFAC), and the Red Flag Rules provided for in the Fair and Accurate Credit Transactions Act (FACTA). The second Webinar is titled "Compliance FAQs: What Others in the Gaming Industry Are Asking" and will be held on March 24 at 11 a.m. PST (2 p.m. EST).

"Recent experiences working closely with compliance and audit department leaders at large and small, tribal- and corporate-run casinos clearly indicate that there are misunderstandings and even confusion regarding adherence to certain FinCEN and IRS regulations within their properties' anti-money laundering programs," said Brian Ferrilla, Managing Director of Resort Advantage. "For example, current and pending guidance presented regarding OFAC, FACTA,Red Flags, and patron identity confirmation can leave one with many questions as to the acceptable processes to follow and what the limits are in obtaining and retaining patron personal information."

"In the coming months, FinCEN will be issuing additional regulatory guidance for casino operators covering a wide range of Title 31 issues," said Jim Dowling, Managing Director of Dowling Advisory Group. "As a casino operator, it's important to understand regulatory expectations and the threats posed to casinos through money laundering and terrorism financing. Having robust anti-money laundering (AML), OFAC, and FACTA programs in place, combined with good independent testing will help casinos avoid possible regulatory sanctions. The upcoming webinars will help casino operators improve their compliance programs and prepare for IRS and other regulatory audits."

Parts II and III in the Webinar series will cover the following topics:

  • Part Two: "Compliance FAQs: What Others in the Gaming Industry Are Asking." Experts will respond to questions submitted by attendees of part one of the series.
  • Part Three: "You Think Your Casino is Compliant - Will an IRS Auditor Agree?" Jim Dowling of Dowling Advisory Group will discuss how to develop and implement an effective anti-money laundering program and how to prepare for an audit.

"A comprehensive approach to these critical issues is needed to assure compliance," said attorney David Waddell, President of Regulatory Management Counselors, P.C. "Our goal with this seminar series is to provide casino operators with the knowledge needed to verify that their existing procedures meet all the technical requirements."
